Terms of Service
These terms explain how Social Studio Design works, what you can expect from us, and what we ask of you. We've written them in plain English. Please read them before you use the app. By creating an account or using Social Studio Design, you agree to them.
1. Who we are
Social Studio Design is provided by Total Welfare Solutions Pty Ltd (ABN 48 695 526 839), a company based in Queensland, Australia (“we”, “us”, “our”). You can contact us at hello@socialstudiodesign.com.au, and our website is www.socialstudiodesign.com.au.
2. What Social Studio Design does
Social Studio Design is an AI-assisted tool that helps businesses plan and create social media content, including captions, posts, stories, reels, images and video. It can use the photos and videos you upload, the brief you write, information from a website you ask it to read, and current trends and dates.
Social Studio Design does not post anything to your social media accounts. You download your content and decide what to publish, where and when.
3. Your account
- You need to be at least 18 years old and able to enter a binding agreement to use Social Studio Design.
- If you use Social Studio Design for a business, you confirm you're authorised to accept these terms on its behalf.
- Keep your login details private. You're responsible for activity on your account. Let us know straight away if you think someone else has accessed it.
- Please give us accurate information and keep it up to date.
4. Plans, free trial and payments
Plans
Social Studio Design is offered on monthly or yearly subscription plans. Each plan includes a set number of posts, campaigns, reels, AI photo credits, AI video reels (up to 20 seconds each) and trend reports each month, as shown in the app.
| Plan | Price (AUD, incl. GST) | Each month |
|---|---|---|
| Starter | A$29 per month or A$290 per year | 60 posts, 1 campaign, 20 reels, 20 AI photo credits, 2 AI video reels, 4 trend reports, up to 1 business |
| Pro | A$69 per month or A$690 per year | 200 posts, unlimited campaigns, 60 reels, 60 AI photo credits, 5 AI video reels, 12 trend reports, up to 3 businesses |
| Agency | A$199 per month or A$1,990 per year | 600 posts, unlimited campaigns, 200 reels, 200 AI photo credits, 12 AI video reels, 30 trend reports, up to 10 businesses |
Extra packs: 20 extra AI photo credits for A$9; 3 extra AI video reels for A$29. Prices and allowances shown in the app at the time you buy are the ones that apply.
Free trial
New customers can start a 3-day free trial, which includes 10 posts, 5 AI photo credits, 2 reels and 1 AI video reel. A card (or your Apple ID) is needed to start the trial. Unless you cancel before the trial ends, your subscription starts automatically and you're charged for the plan you chose. You can cancel during the trial at no cost.
Billing and renewal
- Subscriptions renew automatically each month (or year, for yearly plans) on your billing date until you cancel.
- Payments on our website are processed securely by Stripe, and App Store purchases by Apple. We never see or store your full card details.
- If a payment fails, we may pause premium features until it's sorted out.
- If we change our prices, we'll tell you at least 14 days before the change applies to you, so you can decide whether to continue.
How allowances and packs work
- Monthly allowances start fresh on your billing date each month, which is the day your plan started. On a yearly plan, they start fresh on that same day each month. Unused amounts don't carry over.
- Extra packs don't expire while your account is open, and are used only after your monthly allowance runs out.
- If an AI photo or AI video shot can't be made because of a problem on our side or our providers' side, it isn't counted.
- AI photos come in three kinds. Standard is included in every plan. Realistic photos (made with Google's image AI) are included with Pro and Agency. Premium photos (Google's most detailed image AI, at a higher resolution) are included with Agency, and each Premium photo uses 2 AI photo credits from your monthly allowance or packs (Standard and Realistic photos use 1). The app shows how many each kind uses before you create one.
- Allowances and packs have no cash value, can't be transferred, and end when your account is closed.
Cancelling and refunds
You can cancel a website plan any time from Plans → Manage billing, and you can switch plans from the Plans page. Plan changes start straight away, and any difference in price is adjusted on your next bill. Your plan stays active until the end of the period you've paid for, then stops renewing. We don't give refunds for part-used billing periods or unused allowances and packs, except where the law requires it.
Nothing in these terms limits your rights under the Australian Consumer Law. If a service we provide has a major failure, you may be entitled to a refund or other remedy.
If you subscribe through the Apple App Store, your purchase is managed by Apple under Apple's terms, and refunds and cancellations for that purchase are handled through Apple.
5. Your content
“Your content” means everything you put into Social Studio Design, such as photos, videos, logos, briefs, text and website addresses, and everything the app creates for you from it.
- You own your content. To the extent we have any rights in the content created for you, we give them to you. You're free to use it for your business, including commercially.
- You give us permission to use it to run the service. That means storing, processing and sending it to our AI providers so we can create what you ask for. We don't use it for anything else, we don't sell it, and we don't use it to train our own AI models.
- You need the rights to what you upload. Only upload material you own or have permission to use. That includes photos of other people. Please get their consent, especially for patients, children or anyone in a vulnerable situation.
6. About AI-generated content
AI is a powerful tool, but it isn't perfect. Content created by Social Studio Design may sometimes be inaccurate, out of date, look similar to other material, or not suit your audience. Before you publish anything, please:
- check facts, prices, dates, offers and claims;
- make sure it follows advertising and consumer laws, including rules against misleading claims and any rules for your industry (for example, health advertising rules);
- check it follows the rules of the platform you're posting on, including labelling AI-generated images or video where required; and
- make sure it reflects your business accurately.
Some features suggest real photos and video from free stock libraries (Pexels and Pixabay). These are used under those libraries' licences, which allow commercial use. Please don't use a stock image in a way that suggests the people in it endorse your business.
You're responsible for what you choose to publish. Social Studio Design doesn't give legal, medical, financial or other professional advice.
7. Fair and respectful use
Please don't use Social Studio Design to:
- create content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that exploits or harms children;
- impersonate a real person or business, or create misleading deepfakes of real people;
- infringe someone else's copyright, trade marks, privacy or other rights;
- spread false or misleading information, including fake reviews or testimonials;
- break the usage policies of our AI providers;
- try to get around plan limits, access other people's accounts, or interfere with the app's security or performance; or
- resell or share access to Social Studio Design without our written agreement.
Some features may have usage limits so the service stays fast and fair for everyone. If an account is used in a way that breaches these terms, we may suspend or close it. Where it's reasonable, we'll talk to you first.
8. Third-party services
Social Studio Design relies on trusted providers to work, including OpenAI and Google for AI generation, Google Cloud for making reels, Supabase for secure storage and sign-in, Vercel for hosting, Stripe, Apple and RevenueCat for payments, and Pexels and Pixabay for stock photos and video. Their services may change or occasionally be unavailable. We choose providers carefully, but we can't control them. Our Privacy Policy explains how information is shared with them.
9. Availability and changes
We're continually improving Social Studio Design. We may add, change or remove features. We aim to keep the app available and reliable, but we can't promise it will be uninterrupted or error-free. Please keep your own copies of anything important. Download your finished content rather than relying on the app as your only copy.
10. Our responsibility to you
We provide Social Studio Design with care and skill. To the extent the law allows:
- we aren't responsible for indirect losses, such as lost profits, lost opportunities or damage to reputation; and
- our total responsibility to you for any claim is limited to the amount you paid us in the 3 months before the claim arose.
Where the Australian Consumer Law applies and our liability can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.
You agree to cover any loss we suffer because of content you upload or publish, or because you broke these terms.
11. Closing your account
You can stop using Social Studio Design at any time. To close your account and have your data deleted, go to Plans → Delete my account in the app (an App Store subscription also needs cancelling in your Apple ID settings). You can also email us. We may close an account if it breaches these terms, or with 30 days' notice if we stop offering the service. If we stop offering the service, we'll refund any prepaid amount for the unused part of your billing period.
12. Changes to these terms
We may update these terms as Social Studio Design grows. If a change is significant, we'll let you know by email or in the app before it takes effect. If you keep using Social Studio Design after that, the updated terms apply.
13. Governing law
These terms are governed by the laws of Queensland, Australia. If a disagreement comes up, please contact us first. Most things can be sorted out with a conversation. If not, the courts of Queensland have jurisdiction.
